These Terms of Use ("Terms") govern your access to and use of the website at www.populateware.com (the "Site"). Please read them carefully. By accessing and using the Site, you agree to be legally bound by these Terms. If you do not agree, please refrain from using the Site.

About Us

The Site is provided by Populate LLP ("Populate," "we," "us," or "our"), a company registered in Singapore.

Access to the Site

We reserve the right to modify, suspend, or withdraw any features or content provided on the Site at any time and without prior notice.

Formation of Contract

  • No contract exists for the sale of any goods until we have received and accepted your order and sent you an order confirmation email. At that point, a binding legal contract is formed.
  • All custom-made and made-to-order pieces are excluded from standard cancellation rights, as detailed in "Your Rights to Cancel".

Product Information & Pricing

  • All goods are subject to availability. If an item is out of stock, we will inform you promptly and issue a refund.
  • The description, specification, and price of goods are as shown on the Site at the time of your order.
  • We continually refine our products and reserve the right to make minor technical changes to specifications that do not materially affect quality or function.
  • We make every effort to ensure prices are accurate. If an error is found before dispatch, we will notify you and offer the option to reconfirm at the correct price or cancel your order for a full refund.
  • Prices quoted are exclusive of shipping, handling, and delivery charges. These costs, calculated based on our delivery partner's prevailing rates for your delivery zone and package specifications, will be itemized and added to the total amount due at checkout. For international shipments, the customer remains solely responsible for any applicable import duties, taxes, or clearance fees.
  • International shipping charges and estimated import duties/taxes are calculated and collected at checkout. While we endeavor to provide accurate 'Delivered Duty Paid' (DDP) pricing via our shipping partner, any unforeseen local administrative fees or discrepancies in customs assessment remain the responsibility of the customer. The customer must provide accurate identification and tax information as required by local law to facilitate shipping clearance.

Payment

  • Payment can be made by the methods indicated on the Site at checkout.
  • You will be charged in the currency indicated next to your choice of country in the top left corner of each page on the Site, regardless of the location of any billing or shipping address that you provide. If the currency shown is different to the denominated currency of the credit or debit card you are using to make the payment, the Company will not be liable for any loss caused by any charges or exchange rates imposed by your credit or debit card issuer as a result.
  • Orders of in-stock products are typically processed within 2 - 5 business days.

Manufacturing Lead Times

  • Standard powder-coated accessories are typically dispatched within 2 – 5 business days.
  • Items requiring specialized processing (including but not limited to bead-blasted and mirror finishes) carry an estimated lead time of 8 weeks.
  • To maintain our quality standards and sustainability commitments, all furniture pieces are manufactured upon order. These items carry a standard estimated production lead time of 8 weeks.
  • Lead times are estimates only and begin from the date of order confirmation and receipt of full payment. While we strive to meet these windows, the company reserves the right to extend lead times due to production complexities or material availability. We will notify you of any significant deviations from the estimated schedule.

Delivery

  • Goods will be delivered to the address you provide.
  • Delivery is facilitated through third-party logistics partners. If a delivery attempt is unsuccessful due to reasons beyond our control, including but not limited to incorrect address data or recipient absence, you must coordinate directly with the carrier to arrange redelivery or collection at a designated point. Any additional costs incurred for storage, redirection, or return to sender will be charged to the customer. The company is not liable for any delay or loss resulting from unsuccessful delivery attempts.

Cancellations & Returns

  • For in-stock items, return or cancellation requests may be considered if submitted in writing to hello@populateware.com within 14 days of delivery. All requests are subject to approval at our discretion.
  • Approved returns must be received within 7 days of authorization, unused, in original undamaged packaging, and in "as-new" resalable condition. The customer bears all shipping, insurance, and handling costs.
  • Refunds are subject to a mandatory quality inspection. We reserve the right to refuse a refund or apply a restocking fee if goods are returned damaged or diminished in value.
  • All custom, made-to-order, or bespoke pieces are final sale. No cancellations, modifications, or returns will be accepted once production has commenced.
